A high court judge has refused to hear the bail plea of ​​Sharjeel Imam and others.

A division bench of Justice Pratabha Singh and Justice Amit Sharma of the Delhi High Court was hearing the bail plea of ​​Jawaharlal Nehru University scholar Sharjeel Imam and others in a case related to the alleged involvement in the 2020 Delhi riots conspiracy. The bench said the matter should be decided before a member judiciary who is not embarrassed.

New Delhi: Delhi High Court judge Amit Sharma on Thursday (July 4) recused himself from hearing a bail plea in connection with the 2020 Delhi riots, which was alleged to be a conspiracy case.

The bail applications also include Sharjeel Imam, an IIT graduate and PhD, and others who have been booked under provisions of the UAPA (Unlawful Activities Prevention Act), The Indian Express reported.

After the change in the list of judges hearing the case, the case was taken up before a division bench of Justice Pratabha Singh and Justice Amit Sharma. The bench said the matter should be listed before another bench of which Justice Amit Sharma is not a member, subject to the directions of the acting Chief Justice.

The next hearing is scheduled for July 24. A large number of workers and students are accused in the case. All of them are facing serious charges under Delhi Police FIR 59/2020. The case is related to the February 2023 riots, which the Delhi Police allege is part of a larger conspiracy to defame the Narendra Modi government.

In the last week of May, Sharjeel Imam, a scholar from Jawaharlal Nehru University (JNU), was granted bail by the Delhi High Court. Imam was accused of making anti-national statements at Jamia Nagar and Aligarh Muslim University in Delhi.

The Imam, who was arrested in January 2020, has been in jail for over four years. He has not been found guilty in any of the cases registered against him. The bail granted to Sharjeel Imam was granted to the arrested person when the police failed to complete their investigation. However, he has not been released from jail yet as he is facing charges under the UAPA in the alleged conspiracy case to cause the Delhi riots.

The Delhi Police have alleged that Imam’s speech during the anti-Citizenship Amendment Act (CAA) protests on the premises of Aligarh Muslim University and Jamia Millia Islamia University caused anger.

After the speech went viral, the police took action against the Imam. Within days, five FIRs were registered against him in Uttar Pradesh, Delhi, Assam, Arunachal Pradesh and Manipur. After surrendering, he was arrested.
