According to the Representation of the People Act, if an MP or MLA is sentenced to 2 years, his office as MP or MLA is cancelled. At one time MPs were given 3 months time to apply even if they were sentenced to prison. But in 2013, the Supreme Court (Supreme Court) in a judgment canceled that special privilege of MPs. As a result, Rahul did not get the minimum time to apply. According to the Representation of the People Act, Rahul cannot contest elections for 6 years even after spending 2 years in jail. If that is the case, the political life of the Congress MP may come under question. If this sentence is implemented, it is far from becoming the Prime Minister, the Congress MP will not be able to contest the Lok Sabha Election before 2034. By that time, Rahul will be 65 years old. In other words, to return to active parliamentary politics, the Congress leader has to get a stay on this punishment anyway.

Rahul has only one way open for now. That is to appeal to the High Court against the judgment of the Surat court. In that case first of all he has to apply in Gujarat High Court. He can also appeal to the Supreme Court. But the former leader of his party, veteran lawyer and former Union Minister Kapil Sibbal is skeptical about how much benefit Rahul will be able to do. He says that not only must Rahul’s punishment be reduced, but he must be proved ‘innocent’ in order to regain the post of MP. However, another section of experts says that Rahul will regain his MP position only if the sentence is reduced by the High Court. Because as per the rules, only imprisonment for 2 years or more disqualifies the post of MP.

Congress sources say Rahul will appeal to the High Court against the Surat court order. The Congress is again claiming that the manner in which Rahul’s MP post was revoked is also illegal. Lok Sabha secretariat has announced the decision to cancel Rahul’s MP post. But as per the rules, only the President can cancel the post of Lok Sabha MP. That too after discussion with Election Commission. Therefore, Congress sources said that the process by which Rahul’s MP post has been canceled can also be challenged in court.
