Sustainability AI and Midjourney—two of the biggest names in the exploding field of AI-generated imagery—and portfolio site DeviantArt have become the targets of a class action lawsuit filed in California on behalf of the artists.

As we’ve covered before, AI-generated imagery is a highly controversial area, where “artists write algorithms not to follow a set of rules, but to ‘learn’ a specific aesthetic by analyzing thousands of images.” The algorithm then tries to generate new images adhering to the learned aesthetics.

The suit is brought forward by three plaintiffs, all actors: Sarah Anderson (of Sarah’s Scripts), Kelly McKernan and Carla Ortiz, who are seeking “compensation for damages caused by Sustainability AI, DeviantArt, and Midjourney, and an injunction to prevent future damages” on behalf of all of the artists affected. Huh.

It makes several more serious allegations:

The lawsuit alleges direct copyright infringement, counterfeit copyright infringement related to counterfeiting, violations of the Digital Millennium Copyright Act (DMCA), infringement of class members’ rights of publicity, breach of contract related to the DeviantArt Terms of Service, and various California violations. has been applied. Unfair Competition Law.

As attorney Matthew Butterick said in his post about the case, the three companies are being targeted by “writers, artists, programmers and other creators” who are “concerned about systems that are heavily copyrighted.” Being trained without any consent, no credit, and no compensation for work done.

Sustainability AI (that create sustainability diffusion) and Midjourney are the companies behind two of the most popular AI-generated art platforms, while DeviantArt—more commonly known as a portfolio and community art site—is being largely covered for its work in fucking. .
